1. Acceptance of Terms

By accessing and using the Storybook Creator application ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a binding agreement between you and Martin Bergmann ("we").

2. Service Description

Storybook Creator is a service that generates personalized children's storybooks using advanced artificial intelligence (AI) technology.

Service Features:

• Text Generation: Uses OpenAI's API to create story text based on your inputs.
• Image Generation: Uses Google's Gemini API to create illustrations.
• Recommendations: Provides book recommendations via third-party affiliate links.
• PDF Output: Compiles generated assets into a downloadable PDF file.
• User Account & Library: Create a free account to save your books to the cloud and access them from any device.
• Share Links: Generate a shareable preview link for your book (watermarked).

The Service is provided "AS-IS" for personal use only.

3. User Accounts

• Sign-in: Accounts are created via Google sign-in or email/password through Netlify Identity.
• Age Requirement: You must be at least 18 years old to create an account.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• Book Library: Books you create while signed in are saved to your account library and accessible from any device.
• Account Deletion: You may request deletion of your account and associated data by contacting us at buchzauber@icloud.com.
• Termination: We reserve the right to suspend or terminate accounts that violate these Terms of Service.

4. Payment Terms

4.1 Pricing

The Service operates on a pay-per-use model. Costs are displayed clearly before payment.

4.2 Payment Processing

• Provider: PayPal
• Currency: EUR (Euro)
• Timing: Payment is required before the final high-resolution generation begins.

4.3 No Refunds

All payments are final and non-refundable.

Because the Service incurs immediate costs (AI generation fees) upon usage, we cannot offer refunds once the generation process has started. By clicking "Pay", you waive your right of withdrawal for this digital service performance.

5. Age Requirements & Eligibility

• You must be at least 18 years old to use this Service.
• This Service is intended for parents and guardians creating content FOR children.
• You warrant that you have the legal capacity to enter into these Terms.

6. Data & AI Providers

We prioritize your privacy and data security through our agreements with AI providers.

6.1 No Model Training

We utilize Paid/Enterprise tiers for both Google (Images) and OpenAI (Text). This means:

• Your story ideas and prompts are NOT used to train their AI models.
• Your uploaded face images are NOT used to train their AI models.

6.2 Server Logging

We have disabled application logging for user inputs on our servers. While we process your data to generate the book, we do not keep persistent logs of your specific story content or uploaded photos beyond the temporary 48-hour generation window.

7. Face Image Uploads

If you use the optional face upload feature:

• You represent and warrant that you have the legal right to upload the photos.
• You confirm you have obtained consent from any individuals depicted (or are the guardian of depicted children).
• You acknowledge that these images will be processed by Google's API in the USA to generate the illustrations.

8. Intellectual Property

Generated Content: AI-generated content generally does not have copyright protection under current EU law. You are granted a non-exclusive right to use the generated PDF for personal, non-commercial purposes. You may not claim copyright ownership of the AI-generated assets.

Service Content: The design, code, and interface of the Storybook Creator are owned by Martin Bergmann and protected by copyright.

9. Library — Temporary Storage Only

The in-app library is a convenience feature, not a permanent storage service.

• No availability guarantee: We do not guarantee that books will remain accessible in the library beyond approximately 24 hours after creation. Books may be removed from our servers at any time without notice, regardless of payment status.
• Download obligation: If you have paid for a book, you must download the PDF promptly after completing the book — ideally immediately. We strongly recommend downloading right after payment. We are not responsible for paid books that were not downloaded before the book became unavailable.
• No liability for unavailable books: We are not liable for any loss, inconvenience, or damage resulting from a book becoming unavailable in the library — including books for which payment was made but the PDF was not downloaded in time.
• Free book limit: You may have at most 2 completed unpaid books in your library at any time. To create additional books you must first pay for at least one existing book.
• No cloud backup: We do not maintain backups of your generated storybooks. The downloadable PDF is the only reliable permanent copy of your book.

10. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS-IS" WITHOUT WARRANTIES OF ANY KIND.

We are not liable for:

• The accuracy or appropriateness of AI-generated content.
• Service interruptions or data loss.
• Any damages arising from your use of the Service.
• Loss of books due to the 24-hour server expiry described in Section 9.

Our total liability is limited to the amount you paid for the Service.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. The exclusive jurisdiction for any disputes is Leipzig, Germany.
